What is the affidavit template for marriage?
An affidavit template for marriage is a formal legal document that is aimed at confirming the existence or validity of a marriage between two individuals. Unlike with a marriage certificate that is issued by a council or county, an affidavit is issued by a private individual in the presence of a notary.
The purpose of the affidavit is to provide verifiable evidence of a marital relationship in various legal, administrative, or immigration processes. The text of a document shall include the following information:
- full name, address and contact details of an affiant (i.e., a person who issues this affidavit);
- date of the wedding, full names of both spouses, and location of the wedding;
- date and signature of the affiant;
- notarization part.
Types of affidavit of marriage
The law does not provide any legislative classification of types of marriage affidavit templates. However, due to the practical necessity, the following types of templates emerged:
- Affidavit of bona fide marriage template. Individuals largely use this type of affidavit for immigration purposes. This is when either spouse or partner wishes to bring their other spouse or partner to live with them in their home country. This template aims to prove that relationships between two people are true and not solely to get through the immigration process. This document could also be referred to as an affidavit of marriage for immigration template.
- Affidavit of common law marriage template. This is another type of affidavit that is used to confirm family relations between two individuals who are not officially married. This document plays an especially crucial role in separation procedures, when either spouse wishes to claim spouse rights, alimony, or part of insurance coverage.
- General affidavit. This is a type of marriage affidavit that is being issued to confirm the existence of marital relations for purposes other than common-law marriages or bona fide marriages.

- Details of the Affiant: This information helps to identify the affiant and includes the affiant’s full name, date of birth, and current residential address. - Additional explanations: Every affiant shall disclose how they know about the wedding. There are possible ways of knowing it, for instance, attending the wedding, seeing photos or videos on social media, the couple’s public confirmation about the wedding, etc.
- Signature and notarization: An affiant shall sign the affidavit of marriage template. Without its signing, a template cannot become a valid legal document. Notarization is another mandatory component that confirms the validity of an affidavit. Usually, notarization takes place in the same state where the affiant lives.
