What is a group program agreement?
A group program agreement is a legal document that outlines the expectations, responsibilities, and rules for participants and organizers of a structured group program or project. This template defines the following terms and conditions:
- details of an organizer (full name, address, and contact details);
- description of a program or project;
- rules of conduct for participants;
- decision-making process in a group;
- dispute resolution between group participants;
- limitation of organizer’s liability.
Parties involved in a group program are the organizer and participants. An organizer is a person or individual who runs a nonprofit organization, educational project, or community program and wishes to engage participants. A participant is an individual who is willing to participate in such a project.
A group contract template shall not be confused with:
- Coach agreement: a contract when a professional coach provides coaching services to another individual in exchange for remuneration; or
- Volunteer agreement: a contract where nonprofit organization engages individuals for participation in the organization’s activities for free.
How to draft a group program agreement template?
Drafting a group program agreement template requires inclusion of a number of essential provisions. Without those provisions a document’s template cannot become an enforceable legal document. Below we made a short list of clauses you have to include in your group program contract:
Details of the Program
Every group program agreement sample shall outline:
- program’s type (e.g., educational project, community program, nonprofit organization, volunteering activity);
- program’s title and purpose or mission;
- type of participation (e.g., remote, in person, hybrid);
- full name and contact details of a program coordinator, etc.
Eligibility Requirements and Legal Disclaimers
One of the most important pillars every group contract template shall include is eligibility requirements for participants, for instance:
- age or professional background;
- location or nationality;
- previous volunteering experience;
- paying compensation or initial fees; or
- health eligibility, etc.
Depending on the type of participation requirements, the text of an agreement shall include important additional legal disclaimers.
For instance, if participation in a program requires involvement in various physical activities, then the template shall include a health eligibility disclaimer. Basically it means that each participant is solely responsible for consulting their doctor prior to participating in a program and that the program organizer cannot be held liable for any subsequent damage, health issues, or death of a participant.
Code of Conduct
One of the most important pillars for every team contract template is a code of conduct for its participants. A code of conduct is a set of rules or guidelines that every program’s participant should follow. Usually those rules include the following obligations:
- Keep confidential all information received or exchanged during participation in the program.
- Do not harass or discriminate against other participants.
- Participate in required sessions, meetings, or other types of gatherings that might be required from participants, etc.
- Failure to abide by the established code of conduct may result in termination of participation.
Media Release Consent
A media release consent is a must-have for every group program agreement template where physical participation is required. Physical participation means attendance of offline events or gatherings, like workshops, seminars, round tables, etc.
A media release allows an organizer to use participants’ photos, videos, testimonials, or likeness for various promotional and marketing purposes. For example, a charity organization may post photos of participants on their Facebook group page with the purpose of advertising or promoting other similar events.
Dispute Resolution
A good group program agreement example shall always address conflict resolution procedure. It allows us to mitigate conflict between participants in an efficient way, as well as prevent its further escalation. The text of a template shall answer the following questions:
- How to file a dispute? Each participant should be able to send their written concern for further consideration.
- Who is in charge? The text of a document shall define a person responsible for internal mediation of conflicts. It could be a program’s coordinator or any other party.
- How is the decision made? The template shall address how exactly the dispute is being resolved.
For a program with few participants, inclusion of a dispute resolution clause might not be crucial. However, when it comes to a group of participants for a nonprofit organization or other projects involving a big number of people, having this clause is a must.
