Volunteer Agreement

What is a Volunteer Agreement?
A volunteer agreement is a legally binding contract between a nonprofit organization and a volunteer that outlines terms and conditions for the provision of volunteering services. The key feature of a volunteer work agreement template is that a volunteer performs the work for free.
The parties involved in a volunteer agreement are an organization and a volunteer. An organization under a contract should only be a non-profit organization like an NGO, church, educational institution, etc. A volunteer could be an individual who wishes to provide certain services for free.
A volunteer agreement contract defines:
- mutual parties’ rights and obligations;
- duration of volunteering work;
- schedule of volunteering services;
- compensation package (if available), etc.
How to draft a volunteer agreement template?
Creating a legally binding volunteer agreement template involves including certain key legal terms. Below we prepared a short checklist of all the information you need to include in your volunteer contract.
Terms of Volunteer Services
A sample volunteer agreement should provide a detailed description of the exact services a volunteer shall deliver. Those services could be listed directly in a contract or be outlined in a separate organization’s policies or documentation.
On top of that, the parties to a sample volunteer agreement should define:
- name of a volunteer’s role or title;
- schedule of services (i.e., specific dates and hours);
- location of services (e.g., organization’s office, church);
- additional training or orientation programs, if required.
Compensation Package
A volunteer contract agreement does not provide any remuneration to a volunteer in exchange for the provision of volunteer services. Therefore, the same should be stated directly in the text of a contract.
If, however, an organization wishes to pay for provided services, in that case the parties have to enter another type of contract—e.g., an employment agreement or service contract.
At the same time, an organization under a volunteer contract agreement may compensate volunteers for the expenses incurred while performing volunteer services. For instance:
- transportation expenses to cover trips back and forth to a volunteer service;
- hot meals and drinks for outdoor volunteering services;
- free uniform or equipment with the organization’s symbol;
- access to training and development opportunities, etc.
Additional Requirements
Depending on the nature of volunteer services and the type of nonprofit organization that engages volunteers, a template volunteer agreement may include various additional clauses.
- Code of conduct. Most volunteers are required to adhere to specific rules and requirements while providing volunteer services on behalf of an organization.
- Previous trainings. Some template volunteer agreements may require individuals to attend training prior to actual volunteering work.
- Background checks. An organization may require volunteers to pass some background checks, to provide references from third parties, or to possess specific certifications.
- Confidentiality clause. Volunteers might be required to keep confidential all information they get access to while volunteering for an organization.

Frequently Asked Questions (FAQ)

1. What is the difference between a volunteer work agreement and an employment contract?
There are a number of differences between those two legal documents.
First, under an employment contract, a business or organization hires a person for specific work under the employer’s supervision. A volunteer under a volunteer work agreement is not a business’s employee or worker. A volunteer decides when and for how long he or she is ready to provide volunteer services.
Second, only nonprofit organizations like religious institutions or nongovernmental organizations can engage volunteers for charity work. Businesses or organizations that operate for profit should hire full-time or part-time employees only.
Thirdly, a volunteer does not get any sort of remuneration for their charity work and volunteer services. While under an employment contract, an employee or worker shall always receive regular payments for the work done.

2. How to end a volunteer agreement contract?
Either party can end a volunteer agreement contract at any time. In most cases an organization may end a contract immediately, while a volunteer might be required to file a short prior notice to an organization.
If a volunteer has been given any equipment (e.g., uniform, printed materials) to provide their services, the volunteer is required to return all that equipment back to the organization.
