For which cases this child support agreement form can be used?
The present template is frequently used by Canadian families to agree on payment of children support outside of a courtroom, including:
- The amount of a monthly support to be paid per each child;
- The frequency of payment support;
- What is covered and what is not by a regular child support payments;
- What happens if the paying parent can no longer pay the agreed amount of a child support due to health or financial problems?
- Revision clause allowing parents to review the amount of a child support at any time?
How to define the amount of a child support when drafting a child support agreement form?
The final figures included in the text of the document cannot be purely a matter of preference. The final amount depends on the paying parent’s income and the number of children as defined by the Federal Child Support Guidelines (SOR/97-175), in force since 1 May 1997.
Interestingly, in case a final document does not align with the real numbers, a court can set it aside at any time.
