What is a car wash agreement?

A car wash agreement is a formal written document that establishes car wash terms and conditions between a service provider and a customer. This is a legally binding document that defines:

  • detailed information of parties involved;
  • description of provided services;
  • mutual rights and obligations;
  • schedule of services;
  • price and payment options; and
  • other provisions (e.g., limitation of liability, no warranty disclaimer, etc.

The parties involved in a car wash contract template are a service provider and a customer. A service provider is a registered business that has a car wash service station or facilities and equipment to provide requested services. State laws do not require holding a special license to be able to provide car washing services. However, a service provider may need to obtain certain environmental authorizations or permits to provide car washing services in certain zones or areas.

A customer is an individual, a legal entity, or a business that needs the car to be washed.

The text of a template shall also address if a service provider can engage third parties and subcontractors for the provision of services.

Customer’s obligations

The list of a customer’s obligations is another important component every car wash agreement template should have. There are a number of general duties every customer should have, for example:

  • to pay in full for provided services;
  • provide access to a vehicle, including keys;
  • notify about existing and hidden vehicle defects that may affect the provision of services.

The exact list widely depends on the type of car wash business. For instance, in the case of a mobile car wash contract, a customer shall provide a service provider with the access to water and electricity to perform services. Apart from that, it is a customer’s obligation to ensure that a service provider has proper access to the location where the car wash should take place. In the case of a manual car wash contract, a customer may not be permitted to enter cleaning facilities. Besides that, a customer shall remove all personal belongings from a vehicle prior to the commencement of services.

Limitation of car wash liability

  • Complete exclusion of liability: A service provider may not be usually liable for (1) loss of personal belongings by a customer; (2) a vehicle’s damage resulting from a customer’s failure to use washing equipment correctly (in the case of a self-service wash); (3) pre-existing defects and damages of a vehicle; or (4) weather-related delays or cancellation of services.

Schedule of services

Another important element for every car wash contract agreement sample is a schedule of provided services. The car wash services could be provided:

  • on a specific date;
  • according to a defined schedule; or
  • on an as-needed basis.

If the parties choose provision of services according to a schedule, the text of a contract should define the exact days/dates and times of provision of services. In case of a provision of services on an as-needed basis, the contract shall address how a customer can book a car wash (e.g., send an email, fill in an online form on the website, etc.).

It is highly advisable for all car wash agreements to contain a short cancellation policy.

Payment provisions
