What is a DJ agreement?
A DJ agreement is a legally binding agreement between a client and a DJ about the provisions of professional DJ services during the specific event. A typical DJ services agreement template sets out key details such as event information, duties and obligations of both parties, cancellation policies, dispute resolution clauses and confidentiality.
Who shall use this DJ agreement template?
This professionally drafted DJ agreement template may be helpful for:
- freelance DJs who provide their professional services as independent contractors;
- professional event planners who solicit DJs for playing music at various events;
- entertainment agencies that organise parties, concerts or music festivals;
- businesses operating in Australia as nightclubs.
This document cannot, however, be used when hiring a DJ as an employee under an employment contract. In that case, another template should be used instead.
What should be included in the DJ Agreement Australia Template?
A standard DJ agreement template should include a number of important elements.
Scope of DJ services
The text of a DJ agreement template must include a detailed description of services to be provided, including:
- venue and location;
- date and time;
- number of guests;
- type of event;
- list of songs and/or music.
Cancellation Policy
It is common for every DJ service agreement template to include conditions according to which either party can cancel the planned event. In that case it is important to agree on how either party should be compensated in case of a cancellation by another party.
If a DJ cancels events, any prepayment or deposit should be returned back to the client. When cancellation is initiated by a client, in that case a DJ should be able to keep the retainer with them.
Payment Terms
This contract should also outline how, when and how much a DJ should be paid for the provided services. Usually the most common payment model the parties prefer to choose is a fixed fee or an hourly rate. Services could be paid by a client in either of the following ways:
- in full upon issuance of invoice by a DJ;
- in full before the date of the event;
- in full on the date of signing this agreement;
- 50% before on the date of signing, and the rest on the date of the event; or
- any other arrangement agreed upon by the parties.
Last but not least, parties should define in the contract if the Goods and Services Tax shall be applicable to the services fee paid.
Obligations of the Parties
A contract agreement for DJ services should outline a clear list of obligations and duties for each party.
A DJ is required to:
- not use alcohol, drugs or any other substances while providing services;
- deliver a set of music as agreed by a client;
- deliver services in a professional and timely manner, etc.
A client is required to:
- provide correct details of a planned event;
- pay in a timely manner;
- provide all necessary equipment.
Liability
Provision of services under a DJ agreement contract is partially regulated by Australian consumer laws. It means that a client has a number of statutory rights which cannot be cancelled or compromised by the provision of this contract, including:
- the right to request the provision of services again; and
- the right to request compensation and a full refund in case of cancellation by a DJ.
Confidentiality
If a client wants to protect their privacy and the privacy of guests invited to the event, inclusion of a confidentiality clause is a must. This clause prevents disclosure of all event’s details by a DJ before or after the event takes place.
