These are individuals or entities who will receive the capital, as well as the number of shares in which the capital must be divided between them.<\/li>\n<li><em><strong>Appointment of the trustees<\/strong><\/em>. A testator can appoint a professional or non-professional trustee to act as a trustee for the created trust fund. A trustee could be the same person as an executor or a separate person or entity.<\/li>\n<li><em><strong>What happens if the life tenant wants to stop occupying the property<\/strong><\/em>. The text of the will must also cover potential life scenarios in which a life tenant may no longer wish to occupy the property. In such a case, the text of the document shall specify what happens next; for example, the property could be let under a separate lodger agreement or tenancy agreement.<\/li>\n<li><em><strong>Termination provisions<\/strong><\/em>. The document should also list conditions upon the occurrence of which life tenancy is terminated. For example, death of a life tenant, remarriage, etc. In case of a revocation, a testator must sign a separate <a href=\"https:\/\/fasterdraft.com\/uk\/product\/notice-of-will-revocation-england-and-wales\"><em>notice of will revocation<\/em><\/a>.<\/li>\n<\/ul>\n<h2>When can a life interest trust be invalid?<\/h2>\n<p>Avoid most typical legal mistakes to prevent the invalidity of your life interest trust in the future.<\/p>\n<ul>\n<li><em><strong>Lack of testamentary capacity<\/strong><\/em>. A testator must be at least 18 years old and of sound mind (<em>Section 7 of the WA 1837<\/em>). The long-standing test for testamentary capacity is based on the famous court ruling in Banks v Goodfellow (1870) LR 5 QB 549. In fact, the testator must understand the nature of making a will and its effects, understand the extent of the property being disposed of, be able to comprehend and give proper weight to the claims of those who might expect to benefit, and not be affected by any disorder of mind.<\/li>\n<li><em><strong>Failure to comply with formal execution requirements<\/strong><\/em> (for more details, please read the section \u201cLegal formalities for executing a life interest trust will in England and Wales\u201d below).<\/li>\n<li><em><strong>New marriage or civil partnership<\/strong><\/em>. Under section 18 of the WA 1837, the new marriage or civil partnership automatically revokes previous wills. This could be a serious risk unless the will was expressly made to contemplate that specific marriage or partnership.<\/li>\n<li><em><strong>Undue influence on the testator<\/strong><\/em>. It requires actual coercion that overpowers the testator\u2019s own judgement, not merely persuasion or emotional pressure (<em>Hall v Hall (1868) LR 1 P&amp;D 481; Wingrove v Wingrove (1885) 11 PD 81<\/em>). Modern cases such as <em>Schrader v Schrader [2013] EWHC 466 (Ch)<\/em> show the courts remain willing to find undue influence where the facts support it, including within families.<\/li>\n<\/ul>\n<h2>Legal formalities for executing a life interest trust in England &amp; Wales<\/h2>\n<p>Once a life interest trust is ready, it does not become valid automatically.
